The Health Insurance Portability and Accountability Act (HIPAA) establishes rules and regulations for the use and disclosure of protected health information (PHI). HIPAA applies to individuals and organizations who have been given access to your health records, in some custodial capacity, whether directly or indirectly granted. There are no HIPAA restrictions on an individual's own rights to use and disclose his/her own records.
With HealthFrame your health record information is entirely in your control. By default, all of the data is stored in the computer(s) you use to run HealthFrame. It is only used, accessed or distributed, if the user takes direct action to do so. Strictly speaking, since the entire record is in the control of the individual whose record this is, HIPAA does not apply.
Even though in the strictest sense HIPAA would not apply, HealthFrame still meets and exceeds HIPAA requirements not only by protecting your personal health records, storing them in an encrypted, password-protected format, but also by giving you control over which portions of your health records you may wish to disclose. In other words, even when you choose to disclose your PHI, you still can control which portions you may choose to omit from electronic transmissions, reports, etc.
Finally, Records for Living does not store or capture any personal health record information. This is true even if you rely on an OpenHealth Service hosted by Records For Living.
